The Privacy Act and your personal information
The Department of Industry, Science and Resources (we, our, us) is bound by the Australian Privacy Principles (APP) in Schedule 1 of the Privacy Act 1988 (Cth). The Privacy Act regulates how we may collect, use, disclose and store personal information. We also manage the storage and retention of records containing personal information in accordance with the Archives Act 1983 (Cth).
National Measurement Institute (NMI) treats all personal information in accordance with our obligations under the Privacy Act. All personal information collected by NMI will be stored and held in accordance with NMI’s obligations under the Privacy Act and the Archives Act 1983 (Cth).
All personal information collected by NMI will only be used and disclosed by NMI for the purposes outlined below and will not be used or disclosed for another purpose without your consent, except where authorised or required by law, and under certain circumstances as detailed in the Department’s privacy policy.
Types of personal information collected
When you submit your online order with the NMI Online Store, NMI (a Division in the Commonwealth Department of Industry, Innovation and Science) may collect certain information about you, including but not limited to the following personal and sensitive information:
- full name;
- gender;
- date of birth;
- residential and/or business address;
- contact details (e.g. telephone or mobile number, email address);
- credit card details;
- country of birth;
- ethnicity;
- proficiency in English language;
- disabilities / impairments if any;
- current employment status;
- educational qualifications;
- billing details;
- any special requirements you may have (e.g. dietary requirements, disability, and assistance requirements to participate in training);
- race and ethnicity; and/or,
- health information.
This information is your personal information for the purposes of the Privacy Act 1988 (Cth) (Privacy Act). In general terms, it is any information that can be used to identify you whether or not the information is true. If the information we collect identifies you, or your identity can be reasonably ascertained from it, the information will be considered personal information.
How collection occurs
We collect your personal information directly from you when you:
- submit an online order through the NMI online store;
- register for training or accredited courses;
- complete government surveys if required for compliance under the National Vocational Education And Training Regulator Act 2011 (Cth) (NVETR act) as part of the accredited training and/or assessment registration process;
- provide information for billing, payment, or customer service purposes.
We will only collect sensitive information about you if:
- you consent
- the collection is authorised or required by law, or
- the collection is otherwise allowed under the Privacy Act.
If you register for accredited training and/or assessment, you will be invited to complete a government survey. NMI is required to collect the information in the government survey under the NVETR Act for the purpose of complying with the Australian Vocational Education and Training Management Information Statistical Standard (AVETMISS).
How do we use your personal information?
Your personal information will be used for purposes including:
- processing your purchase orders and payments
- providing products and services
- delivering and administering training and certification courses, including issuing certificates
- billing, collecting, and refunding payments
- identification of your identity and authentication
- improving the NMI online store and related services
- conducting market research
- contacting you regarding your orders or participation in courses
- complying with legal obligations, such as reporting requirements under the NVETR Act and AVETMISS
NMI will use the information collected in the government survey for the purpose of complying with the NVETR Act and AVETMISS and will disclose the information to the National Centre for Vocational Education Research (NCVER). To the extent possible, your information will be de-identified and aggregated before it is provided to the NVETR.
How do we disclose your personal information?
In order to process your purchase made on the NMI Online Store, your personal information will be disclosed to the following third parties which are located within Australia, in addition to NVETR:
- Web Active Corporation Pty Ltd (ABN 32 086 209 403), operating under the business name eWay, located at their registered office in Brisbane. For further information about how eWay handles personal information, please refer to its Privacy Policy.
- The Verner-Mackay Group Pty Ltd (ABN: 46 010 942 613), operating under the business name aXcelerate, located in Brisbane. For further information about how aXcelerate handles personal information, please refer to its Privacy Policy.
In the course of providing technical support, aXcelerate technical support staff may access personal information when necessary to assist the department with technical support or troubleshooting.
By using the NMI Online Store, your personal information will also be disclosed to Shopify Inc, a Canadian company incorporated in Ottawa, Canada. NMI utilises Shopify and its platform to facilitate the operation of the NMI Online Store.
Please note that overseas third parties are not subject to the Privacy Act and NMI has no control over how overseas third parties handle your personal information. The use of the Shopify platform is subject to the privacy legislation of Canada. Where your personal information is provided to third party suppliers and service providers located overseas, the Department has taken reasonable steps to ensure that overseas recipients of your personal information have processes in place to protect your information. Your personal information will not be shared or disclosed other than as described in this privacy policy unless:
- you consent
- the disclosure is authorised or required by or under an Australian law or court/tribunal order, or
- is otherwise permitted under the Privacy Act.
How we secure personal information
Once our department receives information from you, the information is maintained in a secure environment.
Your personal information is stored in cloud storage administered by Amazon Web Services (AWS). This is securely and exclusively stored in Amazon’s “Asia Pacific – Sydney” Region to ensure compliance with data sovereignty regulations.
Consent
By providing your personal information, you consent to the department collecting, using and disclosing that information in accordance with the Privacy Act and the APPs. If you need to include personal information about another individual in your response, you will need to inform that individual of the contents of this statement and obtain their consent to us collecting their personal information.
On the NMI storefront (administered by Shopify), you will be required to acknowledge your consent in accordance with this privacy policy when enrolling in the accredited course or training. If you are enrolling the student on their behalf, you will be required to acknowledge that you have obtained their consent to provide their personal information for collection, use and disclosure in accordance with this privacy policy. We may require evidence that the student has provided consent for you (e.g. their employer or a staff member of their employer) to provide their personal and sensitive information for collection, use and disclosure in accordance with this privacy policy.
You may choose not to provide your consent to the collection, use and disclosure of your personal information as set out in this privacy notice; however, you will not be able to process your purchase order through the NMI Online Store.

Privacy Information
Under the Privacy Act, NMI is required to have a clearly expressed and up to date policy about the way NMI manages personal information. This policy contains information about how you may access the personal information NMI holds about you, and how you may correct any inaccuracies in that information. We will correct your personal information if it is inaccurate (subject to restrictions on such access/alteration of records under the applicable provisions of any law of the Commonwealth).
It also includes information as to how you may make a complaint about a breach of the Privacy Act, and how NMI will respond to such a complaint.
